1. Introduction

Welcome to EduCard AI. These Terms of Service (“Terms”) govern your access to and use of the EduCard AI platform, including our website, applications, APIs, and all related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

EduCard AI is operated by EduCard AI (“Company”, “we”, “us”, or “our”), a company incorporated in India.

2. Account Usage

To access most features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration and keep your account information up to date.
• Maintain the security and confidentiality of your login credentials. You are responsible for all activity that occurs under your account.
• Not share, transfer, or sell your account to any other person or entity without our prior written consent.
• Not create multiple accounts for the purpose of abusing promotions, circumventing usage limits, or violating these Terms.
• Notify us immediately at hello@educardai.com if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period, at our sole discretion.

3. Content Ownership

Your Content. You retain full ownership of any content you upload, submit, or provide to the Service (“User Content”), including but not limited to PDFs, documents, text, and links. By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to process and transform your User Content solely for the purpose of providing the Service to you.

Generated Content. Flashcards, quizzes, summaries, and other materials generated by the Service based on your User Content (“Generated Content”) are provided to you for your personal or internal use. You may use, modify, and share Generated Content freely, subject to any applicable third-party rights in the underlying User Content.

Our Content. All intellectual property rights in the Service itself — including its design, branding, software, algorithms, and documentation — remain the exclusive property of EduCard AI and its licensors.

4. AI-Generated Content Disclaimer

The Service uses artificial intelligence and large language models to generate flashcards, quizzes, summaries, and other educational materials. While we strive for accuracy, you acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, omissions, or outdated information. It is provided on an “as-is” basis and should not be treated as a substitute for professional advice, verified academic sources, or expert-reviewed material.
• You are solely responsible for reviewing and verifying AI-generated content before relying on it for academic, professional, or any other purpose.
• EduCard AI does not guarantee the completeness, reliability, or suitability of any AI-generated content for a particular purpose.
• We are not liable for any decisions made, actions taken, or consequences arising from your use of AI-generated content.

5. API Usage & Rate Limits

Access to the Service, including any public or internal APIs, is subject to usage limits that vary by subscription plan. You agree to:

• Abide by the rate limits, generation quotas, and storage limits associated with your current plan as described on our Pricing page.
• Not attempt to circumvent, bypass, or exceed your usage limits through automated scripts, bots, or any other means.
• Not use the Service for scraping, data mining, or any large-scale automated data extraction without our explicit prior written consent.
• Not reverse-engineer, decompile, or attempt to extract the source code or underlying algorithms of the Service or its APIs.

We may throttle, suspend, or restrict access to accounts that exceed their allotted limits or engage in abusive behavior. We reserve the right to modify usage limits at any time with reasonable notice to affected users.

6. Payment & Refund Policy

Certain features of the Service require a paid subscription. When you subscribe to a paid plan, you agree to the following:

• All fees are charged in advance on a recurring basis (monthly or annually) according to the plan you select.
• Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date.
• You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period.
• Refunds are available within 7 days of the initial purchase or renewal, provided you have not substantially used the Service during that period. To request a refund, contact us at hello@educardai.com.
• We reserve the right to change our pricing at any time. Existing subscribers will be notified at least 30 days before any price change takes effect on their account.

7. Prohibited Conduct

You agree not to use the Service to:

• Upload, transmit, or process any content that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable.
• Infringe upon or violate the intellectual property rights, privacy rights, or other rights of any third party.
• Distribute malware, viruses, or any other harmful software through the Service.
• Interfere with or disrupt the integrity, performance, or availability of the Service or its underlying infrastructure.
• Use the Service for any purpose that is illegal under applicable law.

8. Limitation of Liability

To the maximum extent permitted by applicable law, EduCard AI and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total cumulative liability to you for any and all claims arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

You may delete your account at any time through your account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy, except where retention is required by law.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify you by email or through a prominent notice on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at hello@educardai.com. We will make a good-faith effort to resolve the matter within 30 days.
